Judicial property auctions in Spain (BOE portal): mechanics and data
Spanish judicial auctions of real estate run electronically on the State Official Gazette portal (subastas.boe.es). InversionNPL tracks them and their outcomes: 5,335 auctions tracked, 1,913 currently live, 25.1% of concluded auctions with a known outcome had no bidder; median auction value €114,993.
Mechanics
- Registration on subastas.boe.es with a Spanish digital certificate.
- Deposit to bid: 20% of the auction value (Organic Law 1/2025).
- Twenty calendar days of bidding; extended if a bid arrives in the last hour.
- Award to the best bidder at the thresholds of LEC arts. 670–671 (70% of the auction value, with special rules below that); if no bidder, the creditor may take the property (art. 671) or assign the award (art. 647.3).
- Payment of the balance, award decree, transfer tax (ITP) on the higher of price and cadastral reference value, registration and possession.
